Neighbour’s tree hanging over the fence — what you can actually do

I’m Chris from Bayside Trees in Black Rock. If a neighbour’s overhanging tree is dripping into your yard, scraping the roof or blocking the clothesline, the first question I hear is usually: “Can council make them fix it?”

Short answer for Victoria: usually no. Both Bayside City Council and the City of Kingston treat private neighbour tree arguments as a civil matter. The Victorian Government’s Trees in Victoria page says your council won’t help resolve a dispute or cut the tree back for you unless it’s on council land.

This is not legal advice. I’m a tree bloke. Confirm with council, the Dispute Settlement Centre of Victoria, or your own lawyer before anyone picks up a saw.

Want a practical next step? Send clear photos of the overhang and your suburb, or text 0402 080 770. I can tell you what a proper tree prune looks like on your side of the fence.

Will council fix my neighbour’s overhanging tree?

No — not for private-to-private overhang. Kingston’s private trees FAQ is blunt: council is unable to assist in private neighbour tree matters. They point you to talking it through, getting your own advice, and if needed free DSCV mediation on 1300 372 888.

Bayside’s public pages focus on permits and protection on private land, not umpiring next-door arguments. Street trees and nature-strip trees belong to council; don’t prune them yourself. Call Bayside on (03) 9599 4444 or Kingston on 1300 653 356.

Can I cut branches hanging over my fence in Victoria?

Often yes — but only the bit that has crossed your boundary, from your side, and without wrecking the tree. Victoria Legal Aid’s LawHub page and the Victorian Government describe the common-law right of abatement: cut back encroaching branches, leaves or roots, generally at your own cost.

Practical rules on jobs in Black Rock and Brighton:

  • Talk first before tools come out
  • Stay on your land — entering theirs without permission is trespass
  • Don’t cut past the boundary into their canopy as a wall of stubs
  • Offer the cuttings back tidy
  • You’re liable for damage you cause to their tree

Pruning must sit inside Australian Standards. Use proper cuts under AS 4373, not a fence-line wall cut.

Do I need a permit to prune a neighbour’s overhanging tree in Bayside or Kingston?

Maybe. Check whether the tree is protected before any serious cut.

  • Bayside: Local Law triggers, Significant Tree Register, planning overlays including VPO3 and statewide canopy rules can apply. Check the pruning permit guide.
  • Kingston: Most private trees are protected under planning and/or Local Law. Contact Vegetation Officers on 1300 653 356 when unsure; see our Kingston tree permit guide.

If the tree is protected, you may need a permit before you abate.

Who pays, and what about leaf litter?

Usually you pay if exercising the right of abatement, unless your neighbour agrees to share or do the work. Tree owners are not generally obliged to fund maintenance just because branches overhang.

If the tree has damaged your property, gather evidence and talk first. Leaf litter, flowers, sap and sticks from a healthy tree’s normal life cycle are usually not treated as a private nuisance.

What if my neighbour won’t talk?

1. Keep it neighbourly in writing — a short note beats a surprise chainsaw.

2. Use free mediation — DSCV is free, voluntary and confidential. Call 1300 372 888 or visit disputes.vic.gov.au.

3. Court is last resort — get legal advice first; views and shade alone rarely get you there in Victoria.

How should overhanging branches actually be pruned?

Selective, to standard — not a flat wall along the fence. On Bayside lots we plan boundary pruning so cuts land at proper branch unions, the tree keeps a natural form, and we don’t strip half the canopy in one hit.

If the only quote is a hedge of stubs to the colourbond, expect suckers, dieback and a complaint. I won’t quote a wall cut.

Can Bayside Trees help without starting a fight?

Yes — that’s most of these jobs. I can look at photos, tell you what’s realistically prunable from your side under AS 4373, flag a likely permit path, speak calmly with the neighbour if you want, complete the prune, remove green waste and leave the place tidy.

I won’t invent fees, promise council will force a removal, or cut into their yard without permission. We’re local, fully insured, and trusted on 300+ five-star Google reviews. Text 0402 080 770.

Frequently asked questions

Can I cut my neighbour’s overhanging tree in Victoria?
Often yes, back to the boundary from your land under the common-law right of abatement — after checking permits/protection, ideally after talking, and without damaging the tree. Confirm on vic.gov.au/trees-victoria.

Will Bayside or Kingston council make my neighbour prune?
No for private neighbour disputes. Both point you to talking it through and, if needed, DSCV mediation.

Do cuttings go back over the fence?
Offer them back tidy. They remain the tree owner’s property unless they ask you to dispose of them.

Is this legal advice?
No. It’s a practical guide from a Black Rock arborist, checked against government and council pages on 21 September 2026. Confirm with council, DSCV or a lawyer for your situation.

If you want the overhang handled properly — not hacked — send photos and your suburb, or text 0402 080 770.
